A ATUAÇÃO DO CONSELHO TUTELAR NA GARANTIA DOS DIREITOS PREVISTOS NO ECA: O PAPEL E DESAFIOS ENFRENTADOS POR ESSE ÓRGÃO

Abstract

This article aims to critically examine the role of the Guardianship Council in the realization of the rights guaranteed by the Statute of Children and Adolescents (ECA), highlighting its social relevance and the main obstacles faced in daily practice. The research uses a qualitative and descriptive approach, based on a literature review and document analysis of legislation, institutional reports, and academic studies. It starts from the understanding that the Guardianship Council is an important body for the realization of comprehensive protection, according to the principles established by the ECA. However, the results show that its performance is frequently compromised by structural limitations, such as insufficient material and human resources, weak continuing education for council members, and poor articulation with the intersectoral protection network. These factors result in heterogeneous practices among municipalities, affecting the quality and universality of services. It is also found that the effectiveness of the Guardianship Council depends directly on the strengthening of public policies, professional development, and the expansion of dialogue with society. The study highlights that integration between the Guardianship Council and other network bodies, such as schools, health units, social assistance services, and the Public Prosecutor's Office, is relevant to addressing rights violations and consolidating a culture of protection for children and adolescents.
