TRIBUNAL DO JÚRI: A INFLUÊNCIA DE FATORES DIVERSOS NA DECISÃO DOS JURADOS

Abstract

The present work has the objective of demonstrating the possibility of influence of several factors in the decision of the jury of the jury, which is formed by members of society to judge cases of intentional crimes against life. The fact is that as the judge is a person, however much he is based on sustained criteria and is guided by guiding bases in the decision-making process, he will be subject to problems of his own human characteristic, which, consequently, affected his positioning of the jury court. Several different premises are capable of leading the person to adopt a position that, naturally, he would not adopt, such as a good oratory at the time of the defense, the way in which the media treated the crime in question, the way in which the crime was committed, such as characteristics of the perpetrator of the crime and even his social status. Thus, it is concluded that it is entirely possible for such factors to tend to the positioning of the togados present in the jury's rite. The methodology adopted is a bibliographical, inductive review.
