ANÁLISE SOCIOJURÍDICA DO ALCANCE E LIMITAÇÕES DA LEI MARIA DA PENHA

Abstract

According to Maria da Penha: "life begins when violence ends", we will clarify the painful story of Maria da Penha Maia Fernandes, where she spent the worst moments of her life being raped, and after 20 years in search of justice, she became a symbol of the fight against violence. We mention the advances and limitations of the Maria da Penha Law, for which she became known. Although the law has been in effect for years, there are still enormous difficulties in transforming it into an effective law. Law 11.340/06 has become the best known among the population, but it is not enough to solve such a complex problem; there has to be political, legal, and social commitment. There is a need for police authority, resources, and qualified professionals to receive those who arrive violated and afraid, and a network is necessary to give security to the victim and show that measures will be taken. Therefore, the specific objectives were to analyze violence against women in Brazil from a structural perspective; the Maria da Penha Law from a historical, dogmatic and social perspective and the socio-legal analysis of the reach and limitations of the Maria da Penha Law.
