| Resumo: | O presente trabalho tem como objetivo analisar o instituto da responsabilidade civil, previsto no Código Civil Brasileiro de 2022, os princípios basilares da família, presentes nos artigos 229 e 230 da Constituição Federal de 1988, e o Estatuto do Idoso, regulamentado pela Lei nº 10.741/03. As normas supracitadas tratam sobre as formas de responsabilidade civil para aqueles que causarem danos a outrem, mesmo que por ato imoral, sobre os princípios que regem a família e a lei de proteção ao idoso, respectivamente. Diante das mudanças e evoluções na sociedade atual, surge a seguinte questão: é possível que o abandono afetivo ao idoso seja um quesito de análise para que haja responsabilização civil? O presente estudo se propõe a analisar essa questão, buscando verificar se o abandono afetivo ao idoso pode ser considerado um ilícito civil e, portanto, passível de indenização. |
| Abstract: | This paper aims to analyze the institute of civil liability, provided for in the Brazilian Civil Code of 2022, the basic principles of the family, present in Articles 229 and 230 of the Federal Constitution of 1988, and the Statute of the Elderly, regulated by Law No. 10.741/03. The aforementioned norms deal with the forms of civil liability for those who cause damage to others, even if by immoral acts, the principles that govern the family and the law for the protection of the elderly, respectively. In view of the changes and evolutions in today's society, the following question arises: is it possible that the abandonment of affection for the elderly can be a question of analysis for civil liability? The present study aims to analyze this question, trying to verify if the abandonment of affection for the elderly can be considered a civil illicit act and, therefore, liable to compensation. |
