POLÍCIA OSTENSIVA E VIOLAÇÃO DE DIREITOS HUMANOS

Abstract

The present work has the theme of ostensive police and the violation of human rights. Its objective is to identify the humanitarian bases capable of guiding the actions of the ostensive police, identifying the main points of practical dissonance and locating eventual spaces for progressive improvement. Initially, human rights considerations were drawn, seeking to identify its jusphilosophical substratum. Then, in order to highlight the historicity of fundamental rights, they were pointed to several generations or dimensions of fundamental rights as indicated by the most authoritative doctrine. Conceptual and expressive lines of social rights foreseen in article 6 of the Federal Constitution of 1988 were drawn up and public safety recognized as a true social (and therefore humanitarian) right of the citizen. The organization of the security forces, as carried out by the Constitution was also analyzed, where the main security forces were highlighted and the lines that distinguish the judicial police from the ostensive police were drawn. Next, considerations were made on the most striking topics about violence and human rights violations, seeking integrated interpretation in light of the failure to effectively realize social rights in marginalized communities. It was also stressed the need for the reconstruction and rescue of the culture of human rights, which necessarily passes through the correct understanding of its content. For that, the inductive method, developed in light of bibliographical survey and analysis of statistical numbers, besides official technical information was used.
