Abstract:
The judicialization of the right to health portrays the sad reality of patients before medicine. In case of refusal to comply with the rights of the patient citizen, judicialization is required. In the case of patients with Amyotrophic Lateral Sclerosis (ALS), more and more citizens turn to the judiciary to claim their rights. The research method in the present work is a bibliographic review, which aims to describe the judicialization of health mainly in Brazil referring to the cases of patients with ALS. Therefore, the dignity of the human person is based on the Federal Constitution of Brazil, which allows the judge to pronounce his broken decision on the centralization of human values.
