Abstract:
This paper aims to analyze the influence of the media in the criminal process. The
research was done about seeking to understand the current stance adopted by the
media on the issue of crime, the criminal and its inadequate exposure by the media
outlets against the constitutional principles that are guaranteed to the investigated,
accused. A brief analysis was made of the media in the trajectory of humanity, the
power of the media, the rights and guarantees of the accused, the right to the press,
information and criminal populism. Addressing Penal Populism that within a context of
strengthening the expansion of the penal system and a maximum criminal law through
the movement of viewers with formed and punitive opinions, creating a type of criminal
policy through the manipulation of the media. The study also portrays specific cases
such as Isabela Nardoni and Eloá Cristina Pimentel. Regarding the results, the
research revealed that the media phenomenon has a great influence on the criminal
justice trials, and in a way, has caused damage with respect to several fundamental
rights of the accused.
