Abstract:
The balance and sustainability of the environment are a fundamental right and are
implicit in art. 5 of the Federal Constitution. The Constitution granted the Government
an obligation to protect the environment and to all citizens the right and moral duty to
preserve natural resources. This work aims to understand Environmental Protection
and its objective is to demonstrate the need for greater attention on the part of the
constitutional legislator with the environment and wild animal trafficking. The
methodology used in the work on screen was a bibliographical research, through
consultation in doctrines, scientific articles, official websites of non-governmental
organizations, but that practice actions of public interest, in particular the National
Network to Combat Wild Animal Traffic (RENCTAS) The general objective of this
work is to understand how Environmental Law can help combat the illegal trade in
wild animals, in order to maintain the ecological balance and conserve biological
diversity, ensuring that future generations can live in harmony with nature. The
specific objectives consist of: understanding the ecologically balanced environment
as necessary for a healthy quality of life; analysis of animal rights, as well as the
rights of nature, within an ecocentric perspective, beyond the literalness of article 225
of the Federal Constitution; understand how the principle of environmental education
can contribute to solutions for preventing the trafficking of wild animals; analyze the
law on environmental crimes, in particular the crime of trafficking in wild animals, and
finally; Study how RENCTAS has contributed to preventing the fight against the
global illegal trade in wildlife. It is perceived that laws and government bodies have
not been able, despite efforts, to resolve the problem. For that, one must count on the
help of society as a whole. The importance of broadening the discussion on the topic
is perceived, which is the primary objective of this research, contributing to the
promotion of environmental education as a principle capable of contributing to the
preservation of our ecosystem.
