Abstract:
This study aims to discuss cultural rights, historical heritage and the challenges to the
protection of the historic center of Goiânia, as well as to identify and describe what
causes the overvaluation of property rights in relation to cultural rights. The present
research is theoretically anchored in the theory of “Direito Achado na Rua”, seeking,
mainly, the perspectives of Roberto Lyra Filho and José Geraldo de Sousa Júnior,
showing us that the rights exists beyond the law and, therefore, it is imperative to
analyze the rights cultural activities of Goiás on the streets. There is also a
discussion about public cultural policies existing in Brazil, as well as showing which
are the instruments for protecting cultural heritage. A case study was carried out in
the historic center of Goiânia, investigating how the main cultural heritage of the
region is present. Therefore, qualitative research was used as a method of data
collection, given that the analysis of the cultural center of Goiânia presents
illustrations and information about the real situation of the historical heritage of the
place. From the case study, it can be seen that cultural heritage is extremely
important, as they maintain the collective memory of the members of the municipality.
However, it is noteworthy that part of the assets are vandalized by members of the
population, and in complete disregard by the Government. Thus, it is argued that, in
addition to tipping, revitalization, policing, tougher penalties are needed for
companies that squander the heritage, as heritage education and cultural tourism are
great alternatives for protecting the historical heritage of the historic center of Goiás.
