Abstract:
This research goal is to analyze the reality experienced by Brazilian women in private prison. The approach will bring a brief history of prisons, in addition to examining the divergent form of the law, in which motherhood is found, identifying the rights and guarantees of mothers, pregnant women and children. It was observed that several rights and guarantees are not being properly applied, pointing to different violations of the rights of mothers and babies. Lastly, solutions are suggested so that these problems are properly resolved in accordance with the laws guaranteed to these women and children. So that there is no overcrowding in the prisons, supplying the prisoners with basic hygiene items, providing nurseries (which is also a right warranted by law) for newborns, creating new resocialization programs for incarcerated women and making of home prison requests granted for these women.
