Abstract:
The Dignity of the Human Person as a fundamental principle of our Federal Constitution of 1988 makes the human being the center of the entire legal system. Nevertheless, it is clear that all legal precepts are in accordance with the Magna Carta. The general objective of this monograph is to present, in a well-founded way, the reasons that were essential for the Direct Action of Unconstitutionality nº 5839 of the Federal Supreme Court. Throughout the work, the work of pregnant and lactating women was addressed, as well as their rights and Constitutional guarantees. The developed work proposes an analysis of the Federal Supreme Court's assertion on the decision of unconstitutionality of provisions of the Consolidation of Labor Laws that were in disagreement with the fundamental principles arising from the Labor Reform.
