Abstract:
This monograph portrays how the Police Inquiry is indispensable for criminal prosecution in a Democratic State of Law such as that of our current legal system. However, it is wrongly classified by classical Brazilian doctrine as a mere piece of information, containing relative evidentiary value, being totally unnecessary for the filing of the accusation or criminal complaint. Here, the opposite is demonstrated, as, in fact, it is a relevant tool that protects fundamental rights, producing informative and evidential elements. As well pointed out by Gomes Filho, "it is one of the most important aspects of process science, insofar as the correct verification of the facts on which the parties' claims are based is a fundamental prerequisite for the delivery of a fair decision thus being evident its extreme necessity and effectiveness for the beginning of the processes. The work begins with the description of the Police Inquiry as a whole, while it develops, it shows a modern and realistic view of the current daily life of criminal prosecution using the tabulation and finally, it exposes the need and the reason for being something indispensable for the process, thus aiming to demonstrate that it goes far beyond what is taught in some academic institutions and doctrines.
