Abstract:
The present work analyzes the adoption by homosexual couples, through
questions addressed by the Brazilian doctrine based on the precepts provided
for in the Federal Constitution of 1988, ordinary laws and jurisprudence. The
methodology used is the bibliographic compilation and jurisprudential
positioning study of the superposition courts. It is didactically divided into three
chapters. The first chapter emphasizes families, where it describes concepts,
historical evolution and characteristics that the current scenario presents,
focusing on the Brazilian family and the modern family. The second deals with
the concept of adoption, definitions, types of adoption and the legal procedures
used to complete the formation of a new family. Finally, the third chapter deals
with homoaffective adoption in Brazil, related to doctrinal controversies, court
positions and characteristics on the subject.
