Abstract:
This research aims to argue about the best method used to modify the drug law in
Brazil, regarding cannabis. In addition, it is also intended to problematize the
socio-historical path that led cannabis from something acceptable to something
criminalized in order to systematize a debate about the effects of prohibition of
cannabis. In the proposal to analyze the prohibitionist policy of cannabis, there is a
survey of a theoretical network that meets the need for a process of decriminalization
or legalization of it. It has as general objective of this research, then, the debate
about prohibitionism and criminalization of cannabis in Brazil. Therefore, the
methodical foundation of the research is based on a literature review, qualitative,
research on public policies that deal with cannabis and the effects of its prohibition.
As a result of the research, there is a need for investment/ debates about the
process of decriminalization and/ or legalization of cannabis, with the effect of social
and economic maintenance of the country. Thus, it is concluded in this research that
the current anti-drug law is doomed to failure, either by developing a repressive
system or by promoting a system of self-investment to the public coffers, the process
of monitoring cannabis use and incarceration of cannabis users.
