Abstract:
The crisis in the Brazilian penitentiary system is one of the worst crises facing our
nation. The general objective of this monograph is to understand how the Union will
deal with overcrowding, guaranteeing detainees the fundamental and human right,
with the aim of systematizing the Brazilian Penitentiary system, in the bias of not
being seen simply from the angle of a matter of public order, because in fact it is a
problem of a social nature. The qualitative method was used as a methodological
research procedure, through a bibliographic review in the institution's virtual library
and in the advisor's private collection, in addition to documental research and
analysis of data collected through jurisprudence research, especially from the
Superior Court of Justice. Justice. The result of the research was the numerous
problems faced by prisoners, whether overcrowding, violence, scarcity of resources,
inequality, racism, in addition to the challenges of resocialization. We conclude that
the problem faced is very serious and only through innumerable forms of fighting
crime and means to arrest in a more elaborate and fair way will the country be able to
overcome this chaotic situation.
