Abstract:
The present work aims to present the subject of civil liability and the possibility of
compensation in cases where affective abandonment of children by their parents is
configured. Therefore, it was necessary to study through specific topics on the
subject for a better understanding of the subject. It describes the concept of family in
the Brazilian legal context, addresses civil liability and its derivations, as well as
issues related to family affection and its importance, the rights and obligations of
parents towards their children. Next, the psychological effects of emotional
abandonment in the family environment for the child, their traumas and how their
development can be harmed are presented. Then, the legal consequences of
affective abandonment are discussed, and how the applicability occurs, ending with
the currents that ponder the duty to indemnify in the case where there is affective
abandonment and the positions of doctrines and Courts
