Abstract:
The objective of this research is to conduct a thorough analysis of the Jury Trial
system, with a focus on examining the cultural influence on jurors' decisions. This
endeavor represents an effort to further our understanding of the Jury Trial system
and contribute to ensuring the utmost impartiality in jurors' decision-making. It is
widely agreed that a fair, impartial, and accurate judgment is essential. However,
cultural influence can introduce occasional shortcomings in certain cases. The
research is based on the hypothesis that society is subject to cultural influences that
can lead to erroneous decisions with significant consequences for individuals' lives.
In order to eliminate this possibility of error, exploring the implementation of a new
Jury Trial model, such as the Escabinado Jury Trial, is proposed. This study will
adopt a qualitative research approach, utilizing bibliographic research as the primary methodology. Books available at the FacMais Library will be consulted, along with
scientific papers accessed through Google Scholar. These sources will be
systematically reviewed and analyzed.
