Abstract:
The present article aims to analyze the context in which the Special Criminal Courts
(Juizados Especiais Criminais) were created, as well as their guiding principles.
Therefore, it will initially study the foundation and objectives of the Special Courts, as
well as the factors that preceded the creation of Law 9.099/1995 (Law of the Special
Courts), aiming to provide a better understanding of their functions and role in the
Judiciary. Subsequently, it focuses on discussing the effectiveness of the Special
Criminal Courts, contextualizing the elements that emerged as tools to fulfill the
constitutional principle of access to justice, as provided in Article 5, Section XXXV of
the Brazilian Federal Constitution of 1988. The research adopts a bibliographical
reference methodology, using articles, books, and Brazilian legislation that address
the aforementioned topic.
