Abstract:
Law 11,340 of 2006 established differentiated criminal protection for women victims of domestic violence. This law has multiple faces, its constitutionality being undeniable, as it is intended to prove through this work and its diverse applicability, where the Law currently has been curbing actions of domestic violence, applying to both men and women who attack their partner, as well as among other family members. It can be said that the Maria Da Penha Law presents an advance in relation to legislated Civil Law and in line with the current doctrinal and jurisprudential discussion. Its general objective is to evaluate Law No. 11,340/06 known as the Maria Da Penha Law. The objectives are to research the social assumptions that lead to the promulgation of Law 11,340/06; investigate the applicability of Law No. 11340/06; debate the constitutionality of Law 11340/06. The Maria Da Penha Law was enacted with the aim of resolving domestic violence primarily against women, but today it is known that it applies much further, and can protect any of the spouses or other family members.
