Abstract:
The seizure of the National Driver's License and the retention of the passport are highly
relevant topics in the Brazilian legal context. Both procedures are employed by the State as
coercive measures in specific situations, with the aim of ensuring compliance legal
obligations and prevent potential harm to society. As these measures directly impact the
freedom of movement and the exercise of fundamental rights of individuals, it is crucial to
examine their legality, along with the main legal and social issues involved. In this context, this final course project want to analyze the seizure of CNH and passport in light of the
Brazilian legal system, seeking to comprehend their justifications, legal foundations, and the
primary social impacts resulting from their application. To realize this, it is necessary to
understand the legal principles that support isuch measures, as well as their limitations and
conditions for application. The study will explore current legislation, jurisprudential and
doctrinal interpretations on the topic, as well as the effects of these measures on the lives of
citizens subjected to them. Cases where the seizure of CNH and passport is utilized as a
means to compel debt payment will be addressed, along with situations related to traffic
violations, judicial non-compliance, and other circumstances outlined in the law. By the end
of this study, the goal is to obtain a deep understanding of the seizure of CNH and passport,
evaluating their effectiveness, limits, and potential violations of individual rights. This
analysis will contribute to the legal and social discourse on State coercive measures, aiming to
refine existing legislation and ensure a fairer and more balanced society.
