Abstract:
The present article aims to explore the concept of common-law union in Brazil, from its
conception to its characteristics and differences in relation to marriage. Its purpose is
to better clarify the rights and guarantees of stable union, as well as inheritance rights
and their legal and social aspects. It also deals with a historical approach regarding the
changes and innovations made in Brazilian society regarding customs over the years,
since the traditional Brazilian family has been replaced by other family aspects. Faced
with this historical evolution, it is understood that the law has the duty to accompany
these social changes. Recognized by the Federal Constitution of 1988, stable union is
seen as a family entity, following the principle of family pluralism and respecting Human
Dignity. Although it shares similarities with marriage, such as rights and duties, it differs
in not altering the civil status and in the absence of formalities.
