Abstract:
The role of the judge of guarantees is essential in judicial systems that follow the
adversarial model, aiming to divide responsibilities in the investigation, accusation,
and trial phases. In contrast to the traditional model, where a single judge oversees
the entire process, the judge of guarantees focuses exclusively on the initial phase of
the investigation while a second judge takes over the subsequent steps. This division
seeks to ensure impartiality and safeguard the fundamental rights of those under
investigation. The judge of guarantees acts autonomously, protecting the rights of theaccused and ensuring an impartial investigation, contributing to increasing society's
confidence in justice and preventing injustices and judicial errors.
