Abstract:
This study discusses the possibility of transmitting the duty of providing alimony
under Brazilian law, focusing on avoiding responsibility. Initially, a historical analysis
of the family structure and its accompanying responsibilities is conducted, presenting
the legal foundations and evolution of family law related to alimony. The objective is
to analyze the applicable norms and legislation concerning this issue, considering the
rights and duties of the parties involved. The research consists of a qualitative
bibliographic review, using the descriptive method to address topics such as family
relationships, alimony provision, and avoiding responsibility. The results highlight the
need for a thorough judicial assessment, respecting the principles of the best interest
of the child and adolescent, as well as the protection of the rights of the elderly, whilerecognizing the importance of avoiding responsibility and emphasizing its
complementary and subsidiary nature.
