Abstract:
This paper aims to address the consequences of separation or divorce for the minors
involved. Recognizing that the family is the essential basis for the development of the
human personality, the importance of preserving the right to coexistence between
parents and children is highlighted, even after the breakdown of marital life. The
research analyzes the different types of custody that exist, indicating which of them is
most appropriate in the context of children. The study emphasizes shared custody as
an alternative that promotes unrestricted access of both parents to the child, ensuring
the continuity of the family life cycle. Issues such as education, health, social and
psychological behavior are explored to demonstrate the relevance of the family bond
in the formation of the child. In addition, studies indicate that shared custody is the
most effective measure to prevent and combat abusive practices, such as parental
alienation, providing a healthier and more balanced environment for the minor.
