dc.description.abstract	The aim of this study was to analyze the principle of affectivity in judgments of the Superior Court of Justice (STJ), discussing the adoption of Brazilian law in which the current legislation is a crime. The methodology used is descriptive, seeking to clarify the vision of the theme used, which is not properly disseminated, but which has great relevance in society. Through the main results in studies carried out through principles, it was observed that the judiciary's understanding of the conclusion that socio-affective paternity is equal to biological paternity, and that once built, it is no longer disconnected. Thus, an understanding gained little by little in a society full of prejudice and resistance. Therefore, it appears that the principle of affectivity was the basis for the decisions of the STJ, given that the principle of the dignity of the human person as well as the best interest of the child prevailed.	pt_BR

dc.description.resumo	O objetivo desse estudo foi analisar o princípio da afetividade em julgados do Superior Tribunal de Justiça (STJ), discorrendo sobre adoção à brasileira no qual a legislação atual é crime. A metodologia empregada é a descritiva, buscando clarear a visão ao tema empregado, este que não é difundido adequadamente, mas que possui grande relevância na sociedade. Através dos principais resultados nos estudos feitos através de princípios observou-se que o entendimento do judiciário quanto a conclusão de que a paternidade socioafetiva se iguala a biológica, e que uma vez construída não mais se desvincula. Sendo assim um entendimento conquistado pouco a pouco numa sociedade cheia de preconceito e resistências. Logo, verifica-se que o princípio da afetividade foi bases para as decisões do STJ haja vista que prevaleceu o princípio da dignidade da pessoa humana bem como o melhor interesse da criança.	pt_BR
