Abstract:
The chosen theme will show the reality that the Brazilian people have been suffering from the lack of security in everyday life, where the good citizen is feeling scared and trapped, even in his residence or some other property to which he Belongs. This research aims to show the citizen's right to defend himself within his property, to defend his life and his family. Thus showing society's interest not to get so caught up in the violence of criminals within an area that should be the comfort of their family. However, always defending itself, from the point of view that Brazilian law allows. Through analysis, show the citizen's right to defend himself from the snare of the thing in his possession. Evidenciating through Brazilian ruling laws that the citizen has the right to security and showing that the State is not effective in this role towards society. The data collection took place through a documentary analysis, reading the material collected regarding the research and analysis of the cases present in the legal environment. With these data, it was possible to achieve the expected objectives to establish that the citizen has the right to defend himself within his property, and that society can not be trapped and just watching the criminality growing and going inside his property.
