Abstract:
Of great relevance in the area of law, the subject of Parental Alienation (AP), as well as the Parental Alienation Syndrome (SAP), gained national prominence with the approval of law 12,318/2010, which provides for punishment for the alienation practice seeking to enrich the discussion around shared custody as an effective way to curb parental alienation, an illicit so common and so harmful to children within the family. The objective of this research is to analyze not only the occurrence of the phenomenon, but to analyze the possibility of attributing moral damage when the features and characteristics of the phenomenon of parental alienation are present, highlighting the update occurred by the New Code of Civil Procedure, the present study consisted of in the review of the Brazilian scientific literature on the subject in recent decades.
