Abstract:
The preliminary investigation is the main form of investigation adopted to determine the real truth in the pre-procedural phase. In this way, this monograph started from the purpose of presenting important points inherent to the work carried out by the judicial police in order to dispel the reductionist view attributed to the procedure. It is intended to demonstrate that the investigative activities lack a proper analysis, carried out through the essence, objectives and outstanding characteristics that involve them. That said, it continues with the demonstration of the institute's effectiveness and importance in safeguarding basic rights, which are revealed, mainly, in the resolution of criminal acts and in the fight against new criminal practices. In conclusion, it is intended to validate that a view that is far from simplistic and closer to the interpretation by which the Constitution is concerned, would raise a vision aimed at a greater guarantee of rights.
