RESPONSABILIDADE CIVIL DOS PROFISSIONAIS DE SAÚDE FACE À VIOLÊNCIA OBSTÉTRICA

Abstract

Childbirth is a great and important moment in the pregnant woman's life, and which, due to the violent and inhuman behavior of doctors and other health professionals, becomes a real moment of terror and humiliation, changing life in a negative way - forever - of the woman. This conduct is known by the name of obstetric violence, also called by the WHO as medical violence against the parturient woman, and it frequently occurs in health units by professionals throughout Brazil, subjecting parturient women to all kinds of physical, sexual and psychological suffering, putting the life of the woman and the baby is at risk. This monograph intends to present data on obstetric violence, which is a form of gender violence, relating the violated rights with the civil responsibility of health professionals. The bibliographic research methodology was used, analyzing books, articles, researches and documentaries on the subject. In the first chapters, concepts of gender violence and obstetric violence were discussed, how they occur, what types and how it is approached historically and in Brazil and if society is made aware of the subject, the issue of violation of rights was also analyzed. of pregnant women during the pandemic, and finally, in the last chapters civil liability was dealt with due legal provisions and the omission of the State. And in the end, it was possible to conclude that obstetric violence is a very important issue and must be urgently analyzed and typified.
