Abstract:
The course conclusion work aims to analyze the legitimacy of the embryo, the basic principles of the human person and certain parameters that guide Civil Law. With the modernization and advances in technology and science, it has been bringing about several discussions about how it can interfere with human rights. Brazilian legislation changes according to society, if society changes, therefore the law also changes. But always respecting, the existing norms and not going beyond rights that are inviolable as life. To talk about the legitimacy of the embryo, it is necessary to comment on human cloning, historicity and principles such as human will and dignity. And explaining about the post-mortem succession of embryos, jurisprudence and doctrines allow for an extensive interpretation of the possibility of artificial insemination after one of the deceased dies.
