Abstract:
This monograph aims to analyze and understand mediation as an instrument capable of making the parties understand the starting point of the conflict to solve it, without the need for judicial process, improving the relations between the parties. The main objective of this research is to understand that mediation is an important conflict resolution mechanism that presents proposals for its insertion and seeks paradigm shifts so that it can be effected through social pacification. It is concluded that the application of mediation facilitates the development of dialogue in order to find productive ways of dealing with conflicts. However, the changes brought by the new Code of Civil Procedure have come to give greater value to this institute, providing the broader scope of the dialogue between the parties for the settlement of disputes.
