Abstract:
This study examines the changes in the concept of family in Brazil, focusing on the
changes promoted by the 1988 Constitution and the 2002 Civil Code. In this sense, it
aims to examine how Family Law adjusts to new family formations, such as which are
same-sex, single-parent and reconstituted unions, among others. From this
perspective, a bibliographic methodology is used to analyze current legislation and its
ability to safeguard these family types. However, it is noted that, even with progress,
there are still flaws in the recognition of alternative families and in defining the
obligations of stepfathers and stepmothers. Therefore, it is clear that legislative
updates are necessary to ensure the inclusion and protection of different family models, in order to promote legislation that corresponds to the current demands of
Brazilian society.
