ABSTRACT
The purpose of this paper is to analyze overcrowding, which is a problem faced throughout
the prison system and brings with it numerous imbroglios, some related to the rights of
the prisoner, and others related to the very security of the Society. And this failure
generates a sweeping bankruptcy because it results in an increasing number of violence
and recidivism. This reality completely distorts the purpose of Law 7,210 of July 11, 1984,
that is, the Law of Criminal Execution, throwing in the wind all the principles also brought
by the Brazilian Federal Constitution. Thus, the applied methodology is based on
bibliographic collections, allowing a broad investigation in the materials published in
books, articles, dissertations, theses, doctrines and jurisprudence, reaching a broader
knowledge in order to understand the failures that lead to overcrowding. public chains and
