Abstract:
The present activity of course completion propose a discussion about the instruments
of land occupation, according to the installment of urban land, which settle the
minimal urbanistic standard to implement the allotment to the urban purposes.
Among the institutes of land installment, it is discussed the closed allotment, doing an
analysis of their characteristics and legality, with the end of demonstrate the effective
social function. For that, it is presented in this research the shapes and relevant
aspects of these closed allotments, that are viable ways which optimize the way of
using and occupying the land, making it even more relevant on social role and not
losing the collective aspect. We have got on functionalization of law study by the
Law Functionalist Theory, through thinkers like Norberto Bobbio and studies of the
doctrine. Even though, we analyzed possible causes of emergence of these new
modalities of use and occupation of the land, observing the principal characteristics
of this models of housing inside the walls, also it is discussed the relevance in small
cities, doing a case study of a closed allotment in Inhumas city, Goiás state,
collecting data at Inhumas Property Registration and analyzing data of geographic
and statistical information of Brazil institution. For this study, it was done a research
considering the current legislation, comparing with the doctrine positioning about this
theme, emphasizing legal arguments that substantiate the institution of closed
allotment to contribute to social welfare and property social function.
