Abstract:
This monograph makes an analyzes about pregnant women in the jails of Brazil, aiming
to describe characteristics of those who serve penalty, mainly those who are on
collective habeas corpus, granted on February 20th, 2018, that was granted to benefit
them, and to ensure dignity and offering improvements to their kids, on a purpose to
offer equal treatment towards the society and the possibility of worthy future.
Therefore, it was realized a bibliographic research to demonstrate that pregnant
women, when they go to incarceration, they are treated like the others arrested, it is
not considered the difficulties of this delicate moment in the lives of these women
which, logically, need much more care, and when this situation is disregarded, it is also
disregarded to them, a humanized treatment. It also demonstrates some
characteristics of the female gender, which make them different, inside a prison
perspective, once these peculiarities must be considered. This study also broaches
the subject about Collective Habeas Corpus from Federal Supreme Tribunal,
responsible to ensure the dignity on the lives of these women, aiming to give the correct
treatment to those arrested women and on this way to go through a future of social
realities, with no discriminations concerned to their lives on prison or on their after
prison life, to ensure a more worthy life for the child on mother ́s womb or out of it.
