Abstract:
The work aims to understand Animal Law and its guarantees, presenting the concepts
applied to this new branch of Law, its emergence and inherent principles. However,
the main emphasis applied in the work in question is on the legal protection that the
Brazilian legal system guarantees to animals, having as reference the Federal
Constitution, several laws, at federal, state and municipal levels and the jurisprudence
on the subject. The work also highlights the cases of maltreatment existing in Brazil,
thus highlighting the cultural, economic, social and psychological aspects inherent to
such, also highlighting two issues that have gained prominence in recent days, namely:
bills against animal traction and ban on competitive dog racing. It also highlights the
existence in the Brazilian legal system, of laws and several bills, with the aim of
protecting animals. That said, the importance of expanding studies on the subject at
hand is noted, with the aim of making it understood that animals, as well as humans,
have the right to existence, as they are born equally, providing with regard to the right
to the healing and protection of man.
