Abstract:
This study aims to analyze parental alienation and the effective application of its
sanctions provided for in the legislation. To this end, appropriate and inappropriate
means of sanctions in the national legal system were analyzed. Thus, through this
study, it was possible to present a brief exposition on the main theoretical aspects
that guide this problem and the question of the following question: The sanctions
applicable in the country order, through Law No. 12.318 / 2010, are effective in
fighting parental alienation? In order to arrive at an answer, a historical analysis will
be performed on the concept of parental alienation, as well as the distinction
between parental alienation and SAP. Finally, an analysis will be performed on the
typification of this practice in Brazil and also on the applicable sanctions, provided for
in Law 12.318 / 2010, which contribute to the fight against parental alienation in
Brazil. Finally, the study highlights shared custody as an effective instrument in
curbing parental alienation. The study method to be used, in the present study, can
be understood as bibliographic and documentary and as for the procedure used is
the exploratory, it improves the ideas or discovers intuitions.
