Abstract:
This research aims to analyze the civil liability of the State, in the face of violent
police actions, initially an analysis will be carried out on the formation of the Military
Police body in Brazil, analyzing its creation and evolution as body throughout history,
from more succinctly, we will examine how the specific creation of the Military Police
in the State of Goiás took place. Briefly, this research also discusses how the police
militarization process occurred, and how this militarization influences police actions
in today’s society. The research raised an analysis of several cases of police violence
throughout the country, taking into account all regions of the country, analyzing which
among them have the highest and lowest rates of police violence. Specifically,
geographically, through surveys, the number of cases in which police violence
occurred in the State of Goiás was raised, demonstrating, through real examples,
cases in which the individual was a victim of violent police actions. This research
showed measures adopted by the State called “public policies” which aim to reduce
these rates of police violence in the country. In general, there will be an analysis of
the legal institute of civil liability, analyzing its assumptions and main attributions in
the legal and academic environment, with a main focus on the Civil Liability of the
State, and how this institute is applied in real cases in the legal environment. Finally,
judgments will be observed, especially from the Superior Courts in which the State
was sentenced to indemnify the individual, in cases where it proved ineffective in
providing quality public security.
