Abstract:
This work aims to understand what human dignity means and how it is related to the right to life and abortion, presenting its importance in everyday life and how its civilizational advance took place. The research has as a general objective, to understand the relationship between the right to life and the principle of human dignity based on decisions taken in relation to abortion. The specific objectives, in turn, consist of understanding the principle of human dignity and its legal content; analyze the right to life and relate it to the issue of abortion and verify the legal and jurisprudential hypotheses of abortion allowed by the legal system. The method used was the literature review in works by authors who are dedicated to the study of the topic addressed. The theoretical references used in the research were the doctrines of Luís Roberto Barroso and Daniel Sarmento. In order to analyze the principle of human dignity, it was necessary to point out the evolutionary process of the State up to the current concept of the Democratic Rule of Law and the importance of human rights in this State. It also exposes the right to life and how it is the most important of all, as without it there are no other rights, nor the defense of the existence of human life, which begins from conception. It also shows how the right to life is related to abortion which, although it is commonly practiced nowadays, is still frowned upon by the majority of the population, being an extremely controversial issue. In the end, it was concluded that the discussion on abortion in Brazil is not just a fight between feminist movements, religious entities or political groups, it encompasses much more serious elements such as the construction of a democracy in order to guarantee the fundamental rights of all, as the right to life of the fetus and the dignity of the woman.
