This paper aims to present the topic of Homoaffective Adoption and the contexts that legitimize it, which is treated here raises several questions, among which the following stand out: Historical context of the term family in Brazilian law and its relationship with adoption, History of the conceptions of family in Brazilian law; The family in current Brazilian law; Classification of family in Brazilian Law; Marriage (Marriage Family); Stable union; One-Parent Family; Family entity not explicit in the Constitution; Homoaffective Family; The adoptive family and its regulatory procedure in Brazil; The ways of seeing adoption in the historical course; The regulation of adoption in Brazil.
