Abstract:
Considering the importance of adoption and the value of the family in the formation of individuals, this research intends to analyze the legal possibility of applying civil liability in cases of withdrawal from adoption. Therefore, an exploratory method will be used, based on bibliographic and documentary techniques, with the aim of producing knowledge for future research and to better understand the precepts studied. The general objective of this work is to analyze the legal possibility of applying civil liability for the withdrawal of adoption in the Brazilian legal system, analyzing each of the three stages of the adoption process. Therefore, this work was divided into three chapters. The first discusses the current legal perspective of adoption in Brazil, covering the historical and legislative evolution of adoption, the change in the concept of family and the new family arrangements. In the second, civil liability is analyzed, discussing its elements, species and historical evolution. Finally, in the third chapter, the interrelationship between civil liability and the withdrawal of adoption is analyzed, discussing the doctrinal and jurisprudential position on the proposed theme.
