Abstract:
The fundamental right to education in the 1988 Constitution as a way of developing a
critical conscience for the exercise of citizenship in Brazil constitutes the primordial
foundation for the conquest of rights not yet consolidated in society. In view of the
above, the theme of this monograph is the realization and concretization of critical
knowledge of the Constitution in public schools as a way of providing citizen
autonomy in the consolidation of their rights. The study of the Constitution based on
pedagogical practices contextualized to the legal universe will promote a reflective
discussion around social issues that involve the lack of effectiveness of constitutional
norms in the country. The general objective of the research is to demonstrate how
the strengthening of the legal-constitutional culture in schools can be experienced as
a requirement for the critical development of the exercise of citizenship. Therefore,
the methodology adopted is based on the development of bibliographic research, in a
qualitative approach based on epistemological foundations and with the purpose of
expanding scientific knowledge. The research is based on the analysis of scientific
articles, doctrines, documents, bills, in the Federal Constitution of 1988 and in the
Law of Directives and Bases of Education, instruments that served as a parameter
for reflection on practical action in the face of the proposed objectives. For this
purpose, authors from the areas of law and education were analyzed, among which
stand out: Paulo Freire, Edgar Morin, Boaventura de Sousa Santos and José Afonso
da Silva. The research instrumentalized the need to implement legal concepts in
schools from consistent pedagogical practices of application regulated by the Law of
Directives and Bases of Education. Given this, it is concluded that it is possible to
change the current context of the lack of effectiveness of citizen's rights from the
consolidation of effective educational practices that prioritize the constitutional legal
culture in schools, thus providing the right to citizen education established in the
Magna Carta.
