Abstract:
In the quest for equal treatment among the Federated Entities, it was necessary to show the attributions and immunities of the position of councilman, related to the other Brazilian parliamentarians, to demonstrate how discriminatory the Federal Constitution is in relation to the occupants of the Legislative Branch, since all these political agents are elected by popular vote, which demonstrates violation of the principles of symmetry of norms and equality, by not assigning the same conditions to the positions of councilman, thus having unconstitutionality within the Federal Constitution itself, for violation of said principles who did not treat them equally, and these principles are more important than the rules because they are more flexible and take account of the constant change that society is going through. The study is carried out through bibliographical research while the procedure used was documental research where the decisions of our courts were observed, in order to understand why such a unequal treatment among these political agents.
