Abstract:
According to the World Health Organization (WHO), every child has the fundamental
right to health and a life free from violence. Child sexual abuse (ASI) occurs when a
child is exposed to sexual activities that are beyond their understanding, that areinappropriate for their development and that occur without their consent,
disrespecting laws and social norms. This research aims to answer the following
guiding question: What are the main discussions that Brazilian courts have been
bringing about violence and sexual abuse of children? The article's general objective
is to analyze the obscurities within the family of child sexual violence and abuse in
Brazil. The method adopted was research to review articles and legislation relevant
to the topic. The results show that child sexual abuse encompasses several
situations that violate the child's basic rights, whether through physical or
psychological aggression involving pornography or exposing the child to satisfy an
adult's sexual desires. Through this study, it was observed that the majority of cases
of sexual abuse in childhood occur in the family environment, which leads the child to
feel confused about their feelings and to blame themselves for what happened, and
may express resistance in talking about it. their experiences or even recognizing
what happened. In Brazilian legislation, the Federal Constitution, the ECA and the
Penal Code are fundamental in protecting against sexual abuse and punishing
perpetrators.
