Abstract:
This study aims to systematically analyze, considering the Brazilian legal system, the
mechanisms for preventing and combating moral harassment in the workplace,
highlighting its impacts on labor relations and the well-being of workers. A qualitative
approach was used, based on bibliographic and documentary research, based on
legal doctrine, legislation and national case law. The study identified that, although
there are legal provisions such as the Federal Constitution and the Consolidation of
Labor Laws, which offer support to victims, the absence of specific federal legislation
on moral harassment limits the standardization of protection and punishment
measures. As a result, the relevance of case law in the consolidation of workers’rights was verified, as well as the importance of preventive measures, such as
training, organizational policies and reporting channels. It is concluded that
confronting moral harassment requires not only legislative advances, but also a
cultural change in the workplace, aiming at promoting a more ethical, safe and
respectful space.
